COPYRIGHT AND INTELLECTUAL PROPERTY POLICY

1. Ownership of Content and Artwork
1.1. Artist’s Retained Rights: All original artworks, prints, digital files, designs, and photographic images displayed on the Elev8 Studios website (collectively, the “Artwork”) are the exclusive intellectual property of the artist and Elev8 Studios. 1.2. Copyright: All Artwork is protected by Indian and international copyright laws. The artist retains full copyright, moral rights, and reproduction rights to all Artwork, whether or not the work is sold. 1.3. Website Content: All non-artwork content on the website, including text, logos, layout, and visual design, is the property of Elev8 Studios.
2. Purchase vs. Copyright Transfer
The purchase of any physical Artwork or print does NOT transfer the copyright to the buyer.
2.1. Ownership of Physical Item: When you purchase an Artwork, you own the physical object (the canvas, paper, or medium). 2.2. Rights Retained by Artist: The artist retains the exclusive right to: * Reproduce the Artwork (create prints, merchandise, etc.). * Distribute copies of the Artwork. * Display the Artwork publicly (e.g., on the Website, social media, exhibitions). * Create derivative works based on the Artwork.
3. Permitted and Prohibited Uses
3.1. Permitted Use (Display): Buyers are permitted to display the physical Artwork in private or business settings. 3.2. Prohibited Use (Reproduction): You may not reproduce, copy, scan, photograph, modify, distribute, or use the Artwork for commercial gain without the express, prior written consent of Elev8 Studios. This includes, but is not limited to: * Creating your own prints, posters, or digital copies for sale. * Using images of the Artwork or the digital files for merchandise (e.g., T-shirts, mugs). * Uploading high-resolution images of the Artwork to the internet, including for use in Generative AI, image training, or digital assets.
4. Image Use on Social Media
4.1. Sharing Website Images: You are permitted to share the low-resolution, watermarked images of the Artwork from the Elev8 Studios website on social media platforms, provided that: * Elev8 Studios and the artist are clearly credited in the post caption. * A link back to the Elev8 Studios website is provided. * The images are not altered or cropped to remove watermarks or signatures.
5. Custom and Commissioned Art
For custom or commissioned pieces, the client buys the physical object, but unless a separate, written contract explicitly transfers the rights, the artist retains the full copyright and the right to use images of the Artwork for self-promotion and reproduction.
6. Violations and Enforcement
Elev8 Studios takes intellectual property infringement seriously. Any unauthorized use, reproduction, or distribution of the Artwork or website content may result in legal action, including claims for damages, legal costs, and injunctive relief under Indian copyright law.
